Class Cancellation, Liability Waiver, and Covid-19 Waiver
Cassandra Saindon Fitness understands that life happens and cancellations will happen. All classes can be cancelled and credits refunded on the website up until the class time has started at no charge. Please give as much notice as possible. Once the class has started, you can not cancel and will be considered a no show. No shows, are not refunded. At times, Cassandra Saindon Fitness may need to cancel. Credits will be fully refunded.
For 1:1 Personal Training, sessions can be canceled and rescheduled up until 1 hour of the start time with no penalty. After 1 hour, you lose your session. Please give as much notice as possible. At times, Cassandra Saindon Fitness will need to cancel. If the cancelation/reschedule happens within 1 hour of the scheduled timeslot, you will receive an extra session at no charge.

By purchasing these classes/programs you agree to the following:
I wish to participate in the exercise and training program offered by Cassandra Saindon Fitness. I understand there are inherent risks in participating in a program of strenuous exercise; consequently, I have been examined by a physician of my choice and have obtained his/her approval for my participation in a fitness program within sixty (60) days of the date set forth. No change has occurred in my physical condition since the date such approval was given which might affect my ability to participate in the fitness program. If a physician has not examined me, I agree to see a physician within sixty (60) days of the date set forth below to obtain his/her approval for my participation in a fitness program. If I choose not to see a physician prior to beginning a fitness program, I do so strictly at my own risk. I further agree that Cassandra Saindon Fitness shall not be liable or responsible for any injuries to me resulting from my participation in the fitness program (whether at home, outdoors or in any fitness facility), and I expressly release and discharge Cassandra Saindon Fitness from all claims, actions, judgments and the like which I or my heirs, executors, administrators or assigns may have or claim to have as a result of any injury or other damage which may occur in connection with my participation in the fitness program, excepting only an injury caused by an intentional act of such person or persons. This Release shall be binding upon my heirs, executors, administrators, and assigns.
I understand that I am not obligated to perform nor participate in any activity that I do not wish to do and that it is my right to refuse such participation at any time during my training sessions. I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform Cassandra Saindon Fitness.
Covid 19 Waiver
CORONAVIRUS COMMON AREA USE ADVISORY
Risk of Use: The Coronavirus (COVID-19) pandemic is a worldwide risk to human health. COVID-19 is highly contagious and has a mortality rate many times greater than the flu. COVID-19 can spread easily and exponentially. While people of all ages are at risk of catching COVID-19, persons especially at risk are those with compromised immune systems and the elderly. Persons over 65 years of age may be at particular risk.
Stay at Home Order: In order to reduce the spread of COVID-19, the State of California, as well as many California cities and counties have issued “Safer at Home” orders, with exceptions for essential activities.
Acceptance of Risk: By entering into the common area, the guest agrees as follows:
• Use of the common area amenities could expose you or others to COVID-19.
• The Association has made efforts to sanitize these areas periodically, but cannot guarantee that airspace or surfaces will be virus-free.
• When using the common area amenities, members and guests should take all reasonable and necessary precautions to protect yourself and others from the spread of COVID-19. Further, it is your responsibility to exercise care to protect yourself, such as assessing your own risks, which may include age, underlying health conditions, possible exposure to COVID-19, doctor’s recommendations, or local, state and federal recommendations.
• Participant hereby acknowledges that Participant has voluntarily agreed to participate in recreational activities. Participant is aware of the risks and dangers inherent with Activities, and Participant knowingly and willingly assumes the risk of injury, death or loss arising therefrom.
Participant further agrees not to sue, claim against, attach the property of or prosecute the Association, its officers, directors, members, agents, property manager and employees for any injury, death, damages or loss (including, but not limited to, the loss of personal property) caused by or resulting from Participant’s participation in the Activities, the use of the Facilities and the use of any equipment on the Facilities, whether or not such injury, death, damages or loss of personal property was caused by or resulted from the negligent or grossly negligent actions or inactions of the Association or any other cause.
PARTICIPANT FURTHER EXPRESSLY AGREES THAT THE FOREGOING RELEASE IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF THE STATE OF CALIFORNIA AND, THAT IF ANY PORTION THEREOF IS HELD INVALID, PARTICIPANT AGREES THAT THE BALANCE SHALL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT. PARTICIPANT IS AWARE THAT PARTICIPANT IS RELEASING CERTAIN LEGAL RIGHTS THAT PARTICIPANT MAY HAVE, AND PARTICIPANT ENTERS INTO THIS RELEASE OF PARTICIPANT’S OWN FREE WILL. PARTICIPANT FURTHER AGREES THAT NO ORAL REPRESENTATION, STATEMENTS OR INDUCEMENTS APART FROM THE FOREGOING HAVE BEEN MADE.
